Terms of use

The ground rules.

These Terms are an agreement between you and Sporty Shiba, Inc. for using Sender. By creating an account or using Sender, you agree to them and to our Community Guidelines, and you acknowledge our Privacy Policy.

1. Apple’s license terms

Your license to use the Sender app is granted under Apple’s Standard Licensed Application End User License Agreement (“Apple EULA”). These Terms add rules for Sender’s accounts, community and services. They do not replace or override the Apple EULA.

2. Who can use Sender

  • You must be at least 16, or older if your country requires it.
  • Give accurate account information and keep your password private.
  • One person per account. You are responsible for activity on your account.
  • You may not use Sender if we have previously banned you.

3. Your content

You own the videos, sessions, comments and other content you post. To run Sender, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt and display your content. This covers making thumbnails and playable versions, moderating content as described in section 6, and showing your content to the people your visibility settings allow.

While Help improve video features is on, this license also lets us use videos from your public sessions to develop and improve Sender’s video features, including training models, as described in section 4 of our Privacy Policy. You can turn this off at any time. We will not sell your videos or license them to others to train their models.

The license ends when you delete the content or your account, except for backups and records kept for the periods stated in our Privacy Policy, and models trained before your request.

You confirm that you have the rights needed to post your content and grant this license.

4. People in your videos

  • Get permission before posting a video in which another person can be identified.
  • Do not post an identifiable minor without permission from their parent or guardian.
  • If someone asks you to remove a video of them, please do. They can also contact us at support@sendr.club.

5. Zero tolerance for objectionable content and abuse

Sender has no tolerance for objectionable content or abusive users. You may not post or send:

  • Harassment, bullying, threats, hate or targeted abuse
  • Sexual content, nudity, or any content that sexualizes minors
  • Violent, graphic or illegal content
  • Content that encourages dangerous acts outside normal climbing practice
  • Spam, scams, impersonation or misleading accounts
  • Content that infringes someone else’s copyright, trademark or privacy

The Community Guidelines explain these rules in more detail and form part of these Terms.

6. Moderation, reporting and enforcement

  • Posting requires moderation. Content you post is checked by automated moderation, including OpenAI’s moderation service, and by people when needed. Videos are published only after they pass this check. By posting, you agree to this check.
  • Reporting and blocking. You can report any session, comment or profile in the app, and block any account. We aim to review reports within 24 hours and act on confirmed violations.
  • Enforcement. We may remove content, limit features, warn, suspend or permanently ban accounts that break these Terms, with or without notice.
  • Appeals. If you think we made a mistake, email support@sendr.club.

7. Climbing is dangerous

Climbing can cause serious injury or death. Videos, beta, grades and comments on Sender are shared by climbers for information only. They are not professional instruction or safety advice. You are responsible for your own safety, equipment and decisions, and for following gym rules and local laws when you climb or record. Do not record in a way that distracts you or others while climbing.

8. Using Sender fairly

You may not:

  • Copy, scrape or download other users’ content except through features Sender provides
  • Reverse engineer, disrupt or overload Sender, or get around its security or limits
  • Access Sender with bots or automated tools
  • Use Sender to break the law or other people’s rights

10. Sender’s name and services

The Sender name, logo, website and services belong to Sporty Shiba, Inc. If you send us feedback, we may use it without obligation to you.

11. Ending your use

You can stop using Sender and delete your account at any time in Settings → Account → Delete account. Deletion completes automatically after 30 days unless you restore your account. We may suspend or end your access if you break these Terms, if required by law, or if we stop offering Sender. Sections 3 (as to models already trained), 7, 12, 13 and 14 continue after your account ends.

12. Disclaimers

To the extent the law allows, Sender’s services are provided “as is” and “as available”, without warranties beyond those in the Apple EULA or required by law. We do not guarantee that Sender will be uninterrupted or error-free, that content will be kept forever, or that features such as automatic trimming will be accurate. Content posted by other users is their responsibility, not ours.

13. Limits on our liability

To the extent the law allows, Sporty Shiba, Inc. is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, injury arising from climbing activity, or the conduct of other users. Our total liability for any claim about Sender’s services is limited to the greater of US$100 or the amount you paid us in the past 12 months. Some places do not allow these limits, so they may not fully apply to you. Nothing in these Terms limits rights you have that cannot be waived by law.

14. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, except where the law of your place of residence gives you mandatory protections.

15. Changes to these Terms

We may update these Terms. We will post the new version here with a new effective date, and tell you in the app or by email before material changes take effect. If you keep using Sender after that, the new Terms apply.
